Bulgaria's Bar Act (ЗАдв): structure and analysis 2026
Overview of the Bulgarian Bar Act after ДВ No. 17/2026: acquiring lawyer's rights, secrecy, fees, bar bodies and disciplinary liability.
The Bar Act (Закон за адвокатурата, ЗАдв) governs the status of one of the few professions established by the Constitution in Bulgaria. The current version was promulgated in State Gazette (ДВ) No. 55 of 25 June 2004 and has been amended many times, most recently by ДВ No. 17 of 13 February 2026. These latest changes are not cosmetic: they affect the incompatibilities for registration, the election regime of the bodies, the make-up of disciplinary offences and the limitation period for disciplinary prosecution.
This analysis organises the law in force chapter by chapter and outlines the key duties, bodies and the liability regime after the 2026 amendments. It is addressed to practising lawyers, aspiring lawyers and law students who need a quick but accurate professional map of the subject. The text of the law is quoted verbatim from the official consolidated text of the Ministry of Justice.
❓What does the Bar Act govern?

What the ЗАдв governs: subject matter and principles
The subject matter of the law is set out in Art. 1. It does not regulate a single element but the whole framework of the profession, viewed both as a right to practise and as an organisational structure. Art. 2 adds the constitutional basis and the principles that serve to interpret the specific provisions.
Bar Act (ЗАдв)
Art. 1
The provision on subject matter, defining the scope of the whole regulation.
Official Bulgarian text
„Този закон урежда придобиването и загубването на адвокатски права, упражняването и организацията на адвокатската професия...“
Bar Act (ЗАдв)
Art. 2(1)
The constitutional basis and principles: independence, exclusivity, self-governance and self-funding.
Official Bulgarian text
„Упражняването на адвокатската професия е дейност, предвидена в Конституцията, за правно съдействие и защита...“
For a quick orientation in the structure it helps to keep in mind the map of the fourteen chapters. They follow the logic of the life cycle of the profession: access, practice, rights and duties, organisation and liability.
| Chapter | Subject |
|---|---|
| First | General provisions and principles |
| Second | Acquiring the rights of a lawyer |
| Third | Foreign lawyers |
| Eighth and Ninth | Rights and duties of the lawyer |
| Eleventh and Twelfth | Bodies of the bar association and higher bodies |
| Thirteenth | Disciplinary liability |
| Fourteenth | Lawyers’ registers |
Structure of the ЗАдв by chapter (selected)
Acquiring the rights of a lawyer
Access to the profession is regulated in Chapter Two. The cumulative conditions in Art. 4(1) set the entry bar: a completed legal education, an acquired legal qualification, a minimum period of experience, a successfully passed exam and good character. Lawyer status is acquired only by taking the oath and being entered in the bar association’s register.

Art. 4(1)
Cumulative conditions for acquiring lawyer’s rights.
Official Bulgarian text
Bar Act (ЗАдв)
Art. 3(2)
The moment the status is acquired: oath and registration.
Official Bulgarian text
„Адвокат може да бъде само лице, положило клетва и вписано в регистъра на адвокатската колегия.“
Particular attention is due to the regime of incompatibilities in Art. 5, which was amended by ДВ No. 17 of 2026. For judges, prosecutors and investigating magistrates who have been released from office, as well as for certain officials, the law introduces a three-year period before they can be registered as lawyers. This is a substantial practical obstacle that should be checked expressly for every application for registration.
Bar Act (ЗАдв)
Art. 5(2), item 4
A three-year bar to registration after release from a magistrate’s or official position (amended 2026).
Official Bulgarian text
„(изм. - ДВ, бр. 17 от 2026 г.) ...е освободено от длъжност съдия, прокурор или следовател ... ако не са изтекли три години от датата на освобождаване от длъжност“

Lawyer-client secrecy and the inviolability of papers
Legal professional secrecy (адвокатска тайна) is one of the cornerstones of the profession and is protected without time limit. The duty under Art. 45 does not lapse when the case ends or the contract is terminated, but exists without limit in time. As a witness, the lawyer has no right to disclose circumstances entrusted to them.
Bar Act (ЗАдв)
Art. 45(1) and (2)
An unlimited duty to keep the secret and a ban on giving witness testimony.
Official Bulgarian text
To the personal duty of secrecy is added the objective protection of the information carriers. Art. 33(1) declares lawyers’ papers, files and electronic documents inviolable and excludes their inspection, copying, checking and seizure. This provision is a procedural shield that often matters in searches and seizures under the Criminal Procedure Code (НПК).

Lawyer’s remuneration (Art. 36) after the 2026 amendments
The regulation of remuneration underwent one of the most significant changes with ДВ No. 17 of 2026. The lawyer’s basic right to remuneration for their work remains unchanged under Art. 36(1). The change is in how the amount is determined.
Bar Act (ЗАдв)
Art. 36(2)
Freedom of contract and a fairness criterion; the possibility of an absolute sum and/or a percentage outside criminal and non-pecuniary cases.
Official Bulgarian text
„(изм. - ДВ, бр. 17 от 2026 г.) Размерът ... се определя в договор ... Този размер трябва да бъде справедлив, обоснован и да съответства на достойнството на адвокатската професия. Възнаграждението може да се уговори в абсолютна сума и/или процент върху определен интерес ... с изключение на защита по наказателни дела и граждански дела с нематериален интерес.“
The key conclusion from the new wording is that the statutory link to a minimum amount under an ordinance of the Supreme Bar Council (ВАдС) has been dropped. The amount is now assessed against the standard of fairness, reasonableness and conformity with the dignity of the profession, not against a predetermined lower limit. This change follows the line of case law on the binding force of minimum amounts, which called their automatic application into question.
Bar Act (ЗАдв)
Art. 36(3)
Four criteria for setting remuneration where there is no contract.
Official Bulgarian text
„При липса на уговорено възнаграждение адвокатският съвет го определя с мотивирано решение по критериите: фактическа и правна сложност; засегнат интерес; условия на възлагане; квалификация, опит и специализация.“
Bar Act (ЗАдв)
Art. 36(4)
The secondary legislation is now issued by the Minister of Justice jointly with the ВАдС (amended 2026).
Official Bulgarian text
„(Изм. - ДВ, бр. 17 от 2026 г.) Правилата и начинът за прилагане на критериите по ал. 3 ... се определят в наредба, издадена от министъра на правосъдието съвместно с Висшия адвокатски съвет.“
| Aspect | Before the amendments | Current version (2026) |
|---|---|---|
| Lower limit | Bound by the minimum amount in the ВАдС ordinance | The link has been dropped; fairness criterion |
| Criterion for the amount | Not lower than the ordinance | Fair, reasonable, in keeping with the dignity of the profession |
| Body issuing the ordinance | Supreme Bar Council | Minister of Justice jointly with the ВАдС |
| Percentage of the interest | Limited application | Permitted, except in criminal and non-pecuniary cases |

Bodies of the bar
The organisational structure has two levels: bodies of the bar association and higher bodies of the bar. At the level of the bar association, the general assembly, the bar council, the control council and the disciplinary court operate. The terms of office are expressly limited under Art. 100.
Bodies of the bar association
General assembly
The supreme body of the bar association; elects the other bodies by secret ballot (Art. 99, amended 2026).
Bar council
The governing body; keeps the registers and sets remuneration where there is no contract (Art. 36(3)).
Control council
Exercises financial and organisational control over the council’s activity.
Disciplinary court
Hears disciplinary proceedings against lawyers of the bar association.
Bar Act (ЗАдв)
Art. 100
A three-year term and a limit of two consecutive terms in one body.
Official Bulgarian text
Above the bar associations stand the higher bodies: the Supreme Bar Council, the Supreme Control Council and the Supreme Disciplinary Court. The election regime was refined by ДВ No. 17 of 2026, including the introduction of a secret ballot under Art. 99 and the rules for election and additional election under Art. 107 and Art. 108.
Disciplinary liability
Chapter Thirteen governs the disciplinary regime. The make-up of the offence under Art. 132 was updated by ДВ No. 17 of 2026: item 4, on advertising and intermediaries in breach of the law, was amended, item 5 was repealed, and item 7, on concealing obstacles to registration, was supplemented. These changes shift the emphasis to modern forms of unfair client solicitation.

The system of penalties under Art. 133(1) keeps its five-step structure and gradation. It covers both the reprimand as the mildest measure and deprivation of the right to practise the profession in the case of a repeat violation as the most severe sanction.
Bar Act (ЗАдв)
Art. 133(1)
The five disciplinary penalties and their limits.
Official Bulgarian text
The change that practitioners must note immediately is the limitation period. After the 2026 amendment, disciplinary prosecution is extinguished by limitation when no penalty has been imposed for two years from the commission of the violation. The previous wording provided for a one-year period, so the real window for opening and concluding proceedings has doubled.
