Bulgarian school rules: Ordinance No. 10 on school activities

Pravko18 June 202612 min

Ordinance No. 10/2016 (last amended in State Gazette No. 79 of 26.09.2025): school time, forms of study, admission plans and transfers of pupils.

Ordinance No. 10 of 2016 on the Organisation of Activities in School Education is the state educational standard by which every non-specialised school builds its teaching time, forms of study, admission plan and transfers of pupils. For headteachers, school in-house lawyers and experts at the Regional Education Directorates (РУО) it is an everyday working tool, not a theoretical text.

The problem is that the ordinance is in constant regulatory motion. In 2025 it was amended twice, and some of the latest changes enter into force only on 1 July 2026. This creates a real risk of applying a version that is no longer in force, or one that has not yet come into force. This analysis organises the current version and separates clearly what already applies from what is coming.

❓What does Ordinance No. 10 on the Organisation of Activities in School Education regulate?

✅Ordinance No. 10/2016 is the state educational standard (ДОС) that sets the mandatory requirements for the organisation of teaching and non-teaching time, the forms of study, the admission plan, the exams to test abilities, the admission and transfer of pupils, and the teaching of the mother tongue and culture. It was issued under the Preschool and School Education Act (ЗПУО) and binds all non-specialised schools.

What Ordinance No. 10 regulates and its link to the ЗПУО

Ordinance No. 10 is not a stand-alone act. It was issued as a state educational standard on the basis of Art. 22(10) and Art. 146(2), item 3 of the Preschool and School Education Act (ЗПУО). This means that any interpretation of its provisions must be made in the context of the parent act, and the references to specific articles of the ЗПУО have direct normative significance.

Article 1 outlines the six areas that the ordinance regulates. This matters for positioning each specific question correctly: the organisational rules for admission, for example, are found precisely here, and not in the ordinance on assessment or in the ordinance on inclusive education.

Ordinance No. 10 of 2016

Art. 1

The six areas of regulation define the scope of the state educational standard on the organisation of activities.

Official Bulgarian text

„С тази наредба се определя държавният образователен стандарт за организацията на дейностите в училищното образование... задължителни изисквания за организацията на: 1. учебното и неучебното време; 2. формите на обучение; 3. училищния, държавния и допълнителния план-прием; 4. изпитите за проверка на способностите; 5. приемането и преместването на учениците; 6. обучение по майчин език и култура.“

Organisation of teaching and non-teaching time

The school year lasts 12 months and begins on 15 September, and in sports schools on 1 September. This is a stable provision, not affected by the latest amendments, but it is the starting point for all deadlines in organising the teaching process.

Ordinance No. 10 of 2016

Art. 2(2)

Official Bulgarian text

„Учебната година е с продължителност 12 месеца и започва на 15 септември, а в спортните училища - на 1 септември.“

The most significant change in teaching time came with the amendment in State Gazette (ДВ) No. 50 of 2025. Before it the length of the school term was fixed, whereas now Art. 4 introduces a flexible range. Precision is critical here: the range of 17 to 18 teaching weeks refers specifically to the FIRST school term, not to the school term in general.

Ordinance No. 10 of 2016

Art. 4(2)

The flexible terms replaced the previous fixed values. It concerns the first term.

Official Bulgarian text

„(Изм. - ДВ, бр. 50 от 2025 г., в сила от 20.06.2025 г.) Продължителността на първия учебен срок е между 17 и 18 учебни седмици, а в спортните училища - между 19 и 20 учебни седмици.“
ParameterBefore the 2025 amendmentCurrent version

First term (sports schools)20 teaching weeks (fixed)Between 19 and 20 teaching weeks
End of the first termSet by the general ruleThe last working day of the week within the periods under paragraph 2

The change in school terms under Art. 4 after State Gazette No. 50 of 2025

The new paragraph 3 of Art. 4 ties the end of the first term to the mid-term break. Note: the text of this paragraph was further amended by State Gazette No. 79 of 2025, and this amendment comes into force only on 1 July 2026. This is one of the points where mixing versions leads to error.

Ordinance No. 10 of 2016

Art. 4(3)

The amendment from No. 79/2025 comes into force on 1 July 2026: check which version applies to the relevant school year.

Official Bulgarian text

„(Нова - ДВ, бр. 50 от 2025 г.; изм. - ДВ, бр. 79 от 2025 г., в сила от 01.07.2026 г.) За всяка учебна година краят на първия учебен срок е последният работен ден на седмицата в рамките на периодите по ал. 2.“

Do not mix versions

The amendment of the holidays (Art. 14) by State Gazette No. 79 of 2025 is NOT in force at present. It takes effect from 1 July 2026. Until that date, apply the previous version. Before every organisational decision, check the date of entry into force of the relevant paragraph, not only the date of promulgation.

Forms of study under Ordinance No. 10

Article 30 lists the eight forms of study. This is an exhaustive list: a school cannot organise a form outside it. The forms are adopted by the pedagogical council, which means that the decision is collective and must be recorded in minutes.

Ordinance No. 10 of 2016

Art. 30

Eight forms of study. The special schools under Art. 44(1) of the ЗПУО are limited to day and combined forms.

Official Bulgarian text

„Училищното обучение се организира в дневна форма или във вечерна форма, както и в задочна, индивидуална, самостоятелна, дистанционна и комбинирана форма и обучение чрез работа (дуална система на обучение). (2) Училищата по чл. 44, ал. 1 ЗПУО организират само дневна и комбинирана форма.“

The restriction in paragraph 2 is often missed. Schools under Art. 44(1) of the ЗПУО, that is, special schools (for pupils with sensory impairments, reform boarding schools and social-pedagogical boarding schools), can organise only day and combined forms. Applying another form in these schools would breach the ordinance.

The eight forms of study under Art. 30

An exhaustive list: a form outside it cannot be organised.

Day form (дневна)

Evening form (вечерна)

Correspondence form (задочна)

Individual form (индивидуална)

Independent form (самостоятелна)

Distance form (дистанционна)

Combined form (комбинирана)

Work-based learning (dual system)

Beyond the general procedure, Art. 31(2) sets out six cases in which the form of study is recommended by the personal development support team. The last of them concerns a pupil with special educational needs (СОП).

Ordinance No. 10 of 2016

Art. 31(2)

Six cases in which the recommendation comes from the personal development support team.

Official Bulgarian text

„Формата на обучение се препоръчва от екипа за подкрепа за личностно развитие за: ... 6. ученик със специални образователни потребности.“

Changing the form of study

A change of form under Art. 32 is one of the most sensitive procedures, because the competent authority differs depending on the specific transition. In some cases an order of the headteacher is enough, in others permission from the head of the РУО is needed. An important deadline: the head of the РУО rules and notifies the applicants in writing within 10 days.

Ordinance No. 10 of 2016

Art. 32(5)

Official Bulgarian text

„Началникът на регионалното управление на образованието в 10-дневен срок уведомява писмено заявителите по ал. 4 за своето решение.“

Changing the form of study (general model)

1

Identify the ground

The transition is assessed against the changes permitted under Art. 32 before and during the school year.

2

Determine the competent authority

In some cases an order of the headteacher is enough; in others permission from the head of the РУО is needed.

3

Application and decision

10 school days

Where РУО permission is needed, the head rules on the application of the competent persons.

4

Written notification

The head of the РУО notifies the applicants in writing of the decision within 10 days (Art. 32(5)).

With the amendment in State Gazette No. 74 of 2024, new paragraphs 6 and 7 were created in Art. 32, regulating the transition to the dual system of study at the request of a partner employer before the second upper-secondary stage, under the conditions of Art. 12(2) of the ЗПУО.

Ordinance No. 10 of 2016

Art. 32(6)-(7)

A new path to the dual system, tied to the choice under Art. 12(2) of the ЗПУО.

Official Bulgarian text

„(Нова - ДВ, бр. 74 от 2024 г.) ...могат при условията на чл. 12, ал. 2 ЗПУО, преди втори гимназиален етап, да променят формата на обучение в обучение чрез работа (дуална система) при постъпили заявки от работодател-партньор.“

Admission plan: school, state and additional

Chapter Four distinguishes three kinds of admission plan (план-прием): school, state and additional state. The state admission plan for grade VIII in profile-oriented and vocational high schools is set under Art. 142(3), item 1 of the ЗПУО, and admission to grade V under Art. 142(3), item 5 of the ЗПУО. The additional state admission plan is regulated in Art. 142(4) of the ЗПУО.

Preschool and School Education Act (ЗПУО)

Art. 142(3), item 1

State admission to grade VIII. Admission to grade V is under paragraph 3, item 5.

Official Bulgarian text

„Държавният план-прием определя броя на местата... в профилираните гимназии и в професионалните гимназии... - в VІІІ клас.“

Precision when directing pupils with СОП

The directing of pupils with chronic illnesses, physical and sensory impairments and special educational needs is carried out under the procedure of Ordinance No. 10 itself (Art. 95 to 98), through a commission under Art. 97(4), item 2. Art. 120(7) of the ЗПУО does NOT regulate this admission: it is an assessment provision for the qualitative grades of pupils with СОП under an individual study programme and is the statutory designation of the СОП subgroup only.

Transfer of pupils

Transfer under Chapter Five applies to pupils from grade I to XII in non-specialised state, municipal and private schools. For arts schools, culture schools and sports schools the procedure is set in the special ordinances under Art. 146(2), items 1 and 2 of the ЗПУО.

Ordinance No. 10 of 2016

Art. 102

Official Bulgarian text

Transfer is possible only if there is a vacant place. Vacant places are the places up to the approved school and state admission plan, and they are announced within three days of becoming vacant on the school's website and at the РУО.

Ordinance No. 10 of 2016

Art. 104

Definition of a vacant place and the three-day deadline for announcing it.

Official Bulgarian text

„За свободни места се считат местата до утвърдения училищен и държавен план-прием... (2) Свободните места се обявяват в тридневен срок от освобождаването им на сайта на училището и в регионалното управление на образованието.“

The deadlines for transfer under Art. 106 are often quoted inaccurately. The precise position is as follows: for both grades I-VI and grades VII-X, transfer is possible throughout the school year. The limit of 30 school days before the end of each term applies only to grades VII-X and only when the transfer takes place during term time.

Ordinance No. 10 of 2016

Art. 106(1)

Grades VII-X are also year-round: the 30-day threshold applies only to a transfer during term time.

Official Bulgarian text

The 2025 changes and what is coming

In 2025 Ordinance No. 10 was amended twice, and this is key to applying it correctly. The amendment in State Gazette No. 50 of 20 June 2025 introduced the flexible school terms and full-day organisation in the centres for special educational support (Art. 17 to 18). The following amendment, in State Gazette No. 79 of 26 September 2025, is the latest version, but not everything in it applies immediately.

Beyond the amendments already promulgated, a draft of a further amendment and supplement of the ordinance has been published on the public consultation portal. This confirms that the act remains in active regulatory motion, and it calls for periodic checking of the current version.

Entry into force of the individual paragraphs (No. 79/2025)

Most of the amendments under State Gazette No. 79 of 2025 are in force from 26 September 2025. The exceptions are § 1 (the new wording of Art. 4(3) on the end of the first term) and § 2 (Art. 14, new paragraph 2 on the autumn and mid-term holidays by order of the minister), which enter into force on 1 July 2026. Until that date, apply the previous version of these provisions.

Practical tips for applying it

In education law the date of entry into force is just as important as the text of the provision. The following checklist summarises the points where mistakes most often arise in applying Ordinance No. 10.
