Bulgaria disability assessment: TELK, NELK and appeals

Analysis of Bulgaria’s Ordinance on Medical Expertise: types of expertise, the TELK and NELK bodies, disability percentages and how to appeal.

The Ordinance on Medical Expertise (НМЕ) is among the most frequently applied, and most frequently appealed, secondary acts in social security practice. The expert decisions of the Territorial Expert Medical Commissions (ТЕЛК) and the National Expert Medical Commission (НЕЛК) determine the right to a disability pension, to cash benefits and to a wide range of social entitlements, and procedural errors at the assessment stage regularly lead to a court annulling the decision.

In this analysis we set out the current wording of the НМЕ: the two types of medical expertise, the hierarchy of bodies (treating doctor, ЛКК, ТЕЛК, НЕЛК), the logic of the percentage assessment and the chain of appeal up to the Supreme Administrative Court (ВАС). The text is aimed at lawyers working on social security cases, payroll and HR specialists and medical experts who work with the current rules.

❓Which bodies carry out medical expertise under the НМЕ?

✅Expertise on temporary incapacity for work is carried out by the treating doctor (or dentist), by the medical advisory commissions (ЛКК), by the Territorial Expert Medical Commissions (ТЕЛК) and by the National Expert Medical Commission (НЕЛК). Expertise on permanently reduced working capacity and on the type and degree of disability is carried out by ТЕЛК and НЕЛК.

Legal framework: НМЕ, the Health Act (ЗЗ) and ПУОРОМЕРКМЕ

The current Ordinance on Medical Expertise was adopted by Council of Ministers Decree No. 120 of 23 June 2017 and repeals the previous ordinance of 2010 (adopted by Decree No. 87 of 2010). The ordinance sets out the principles and criteria of medical expertise and the procedure for carrying it out, and is issued under the section on medical expertise in the Health Act (ЗЗ).

Take care when citing the primary source

Legal databases also contain the repealed ordinance of 2010 (Council of Ministers Decree No. 87 of 2010). It was repealed when the current НМЕ of 2017 entered into force. When drafting appeals and opinions, cite only the current wording (the consolidated text of the Ministry of Labour and Social Policy (МТСП) or the current version on lex.bg), because citing an outdated version is a common reason for arguments being rejected.

The НМЕ does not operate in isolation. It works together with the Rules on the Structure and Organisation of Work of the Bodies of Medical Expertise and the Regional Files of Medical Expertise (ПУОРОМЕРКМЕ), which govern the composition and organisation of ТЕЛК, НЕЛК and the regional files of medical expertise (РКМЕ), as well as the principle of random allocation of case files. The Rules were also amended by Decree No. 47 of 2024.

Types of medical expertise

The НМЕ distinguishes two main types of medical expertise, which differ in subject matter, competent body and the kind of act issued. Correctly identifying the type of expertise is the first step in analysing any case, because it determines which body is competent and how the decision is appealed.

Comparison of the two types of medical expertise under the НМЕ

Ordinance on Medical Expertise (НМЕ)

Art. 6

Art. 6 НМЕ, amended in State Gazette (ДВ) issue 10 of 2023. The amendment refined the scope of temporary incapacity for work in connection with changes to the Labour Code (КТ), the Social Insurance Code (КСО) and the Health Act.

Official Bulgarian text

„Временна неработоспособност е налице в случаите, при които осигуреното лице не може или е възпрепятствано да работи поради настъпило заболяване или злополука и други посочени в наредбата основания.“

Bodies of medical expertise: treating doctor, ЛКК, ТЕЛК, НЕЛК

Article 3 of the НМЕ sets out the hierarchy of bodies. Paragraph 1 lists the bodies that carry out expertise on temporary incapacity for work, and paragraph 2 provides that expertise on permanently reduced working capacity and on the type and degree of disability is carried out only by ТЕЛК and НЕЛК, with a reference to acquiring the right to a pension under Art. 68 of the Social Insurance Code (КСО).

Ordinance on Medical Expertise (НМЕ)

Art. 3

Art. 3(1) and (2) НМЕ. ТЕЛК are first-instance territorial bodies, and НЕЛК is the national second-instance body.

Official Bulgarian text

„Експертизата на временната неработоспособност се извършва от лекуващия лекар (лекаря по дентална медицина), от лекарските консултативни комисии (ЛКК), от териториалните експертни лекарски комисии (ТЕЛК) и от Националната експертна лекарска комисия (НЕЛК). Експертизата на трайно намалената работоспособност и на вида и степента на увреждане се осъществява от ТЕЛК и НЕЛК.“

ТЕЛК are the territorial expert medical commissions that carry out the first-instance assessment. НЕЛК is the national commission that acts as the review and second-instance body for ТЕЛК decisions. This two-tier structure is key to the appeal procedure, discussed below.

Path of assessment for permanently reduced working capacity

1

Referral to ТЕЛК

The person is referred for assessment, with the necessary medical documentation, through the РКМЕ.

2

Assessment by ТЕЛК

ТЕЛК assesses the permanently reduced working capacity and the type and degree of disability.

3

ТЕЛК expert decision

An expert decision is issued, stating a percentage and a period of disability.

4

Appeal to НЕЛК

If you disagree, the decision can be appealed to НЕЛК as the second-instance body.

5

Judicial review

The НЕЛК decision can be appealed to an administrative court and, on cassation, to the ВАС.

Assessing permanently reduced working capacity as a percentage

The assessment of permanently reduced working capacity and of the type and degree of disability is made as a percentage, based on reference points set out in the annexes to the ordinance. These annexes contain the methodology that medical experts use to determine the percentage for the particular illness or impairment.

Through amendments to the ordinance over the years, the range of cases in which the degree of disability is determined for life, without later re-assessment, has been widened. The specific percentage values and the cases of lifelong determination depend on the version of the annexes in force, so when analysing an individual case you need to check the current consolidated text rather than rely on memory.

Why the accuracy of the percentage is critical

The percentage of permanently reduced working capacity is the legal fact that gives rise to the right to a disability pension, to supplements and to many social entitlements. An error in the assessment, or in the version of the methodology applied, directly affects the scope of the person’s rights and is often a ground for appeal in itself.

Judicial review of the methodology: ВАС Decision No. 1632/2020

The secondary legislation on medical expertise is itself often the subject of judicial review. A telling example is the court’s annulment of part of the methodology for applying the reference points for assessment, which illustrates the importance of procedural requirements when normative acts are adopted.

Supreme Administrative Court (ВАС)

Decision No. 1632 of 31.01.2020

Decision No. 1632 of 31 January 2020 of the ВАС in administrative case No. 10422/2018, three-member panel (eighth division), published in the State Gazette (ДВ) issue 63 of 17 July 2020. The annulment is on procedural grounds: no reasons were given, as required by Art. 28(2) of the Normative Acts Act (ЗНА).

Official Bulgarian text

„Отменя разпоредбата на т. III от Методиката за прилагане на отправните точки за оценка на трайно намалената работоспособност от приложение № 2 към чл. 63, ал. 3 от Наредбата за медицинската експертиза.“

Two clarifications matter when citing this decision. First, Decision No. 1632/2020 was given by a three-member panel and was upheld by a five-member ВАС decision of the same year, so the two acts should not be confused. Second, the annulled item III of the methodology was later restored in identical form by Council of Ministers Decree No. 241 of 2020 (State Gazette issue 79 of 2020). The effect of the annulment was temporary, and the provision should not be presented as permanently gone.

Expert decisions of ТЕЛК and НЕЛК on the disability percentage generate an extensive body of administrative case law. Arguments drawn from this case law should be presented descriptively, and only verified acts should be cited by number, because citing non-existent details undermines trust in the legal analysis.

Appealing expert decisions: НЕЛК and judicial review

The chain of appeal follows the two-tier structure of the bodies and continues in the administrative courts. A ТЕЛК decision is appealed to НЕЛК, and a НЕЛК decision is subject to judicial review before an administrative court, whose ruling can in turn be appealed before the Supreme Administrative Court under the Administrative Procedure Code (АПК).

Chain of appeal for expert decisions

ТЕЛК decision

First-instance expert decision.

НЕЛК

Appeal to the national second-instance body.

Administrative court

Judicial review of the НЕЛК decision under the АПК.

Supreme Administrative Court

Cassation review of the administrative court’s decision.

Check time limits in the version in force

The time limits for appeal to НЕЛК and to the administrative court are set by the НМЕ, the Health Act and the АПК. They change with successive versions of the ordinance, so the specific time limit for each procedure must be established from the text in force at the time the decision was issued. A missed time limit is among the most common grounds for an appeal being declared inadmissible.

Practical guidance for lawyers and employers

For a practising lawyer, analysing a dispute over medical expertise starts with correctly identifying the type of expertise, the competent body and the applicable version. For employers and payroll and HR specialists, the НМЕ directly affects how sick notes are accepted and the obligations that apply to an employee with permanently reduced working capacity.

Checklist for appealing a ТЕЛК decision

Use the checklist when preparing an appeal to НЕЛК or to an administrative court.

Establish exactly the type of expertise and the competent body under Art. 3 НМЕ*

Check the version of the НМЕ and its annexes that applied at the time of the assessment*

Establish the exact time limit for appeal under the version in force and the АПК*

Identify the correct body or defendant in the proceedings*

Consider whether there were procedural defects in the assessment and in the giving of reasons*

Collect and organise the medical documentation supporting the disputed percentage

* Mandatory

Common mistakes in practice

Missing the time limit for appeal; directing the appeal against the wrong body; citing an outdated version of the НМЕ or the repealed ordinance of 2010; confusing three-member and five-member ВАС decisions; and citing court decisions from memory without checking the details in the primary source.
