Bulgaria VAT changes 2026: €51,130 threshold explained
Analysis of the VAT Act amendment (State Gazette 115/2025): new €51,130 registration threshold, small enterprise schemes, annual turnover under Art. 168в.
The Act Amending the Value Added Tax Act (ЗИД на ЗДДС, State Gazette (ДВ) issue 115 of 30 December 2025) is the most extensive change to the Value Added Tax Act (ЗДДС) since it was adopted. With the transposition of Council Directive (EU) 2020/285, entirely new schemes for small enterprises are introduced, along with a new registration threshold in euro and a fundamentally different logic for determining taxable turnover. For legal advisers who counsel clients on VAT questions, not knowing these changes can lead to missed registration deadlines and serious penalties.
This analysis covers the European context (Directive 2020/285), the new threshold of €51,130, the annual turnover under Art. 168в, the two small enterprise schemes (national and EU), the changes for tour operators and dealers, and provides a practical checklist for legal advisers.
❓What are the main changes to the ЗДДС from 1 January 2026?

Directive (EU) 2020/285: the European context
The changes to the ЗДДС are not an isolated national decision but the mandatory transposition of Council Directive (EU) 2020/285 of 18 February 2020, which reforms the special scheme for small enterprises in Directive 2006/112/EC (the VAT Directive). The deadline for transposition was 31 December 2024, with application from 1 January 2025, but Bulgaria, like a number of other member states, transposed it a year late.
Directive (EU) 2020/285
Art. 1, item 12 (new Art. 284а of Directive 2006/112/EC)
Official Bulgarian text
„Държавите членки могат да освобождават от данък доставките на стоки и услуги, извършвани от малки предприятия, установени на тяхна територия, чийто годишен оборот в държавата членка не надвишава прага, определен от тази държава членка.“
The Directive pursues two main goals. First, reducing the administrative burden on small enterprises, which generate minimal VAT revenue but bear disproportionately high compliance costs. Second, introducing a cross-border exemption: for the first time a small enterprise from one member state can benefit from an exemption in another, if it meets certain conditions.
It should be noted that Directive 2020/285 sets the maximum permitted national threshold at €85,000 (new Art. 284, paragraph 1 of Directive 2006/112/EC). Bulgaria has chosen a threshold of €51,130 (BGN 100,000 at the fixed exchange rate), which is well below this maximum. For the cross-border exemption an additional ceiling of €100,000 of total annual turnover in the EU has been introduced.
New registration threshold: €51,130
The central change in the ЗДДС is the rewording of Art. 96(1), the rule that determines when the obligation to register arises. The old regime (BGN 100,000 over a period of the last 12 consecutive months) has been replaced by an entirely new mechanism.
Value Added Tax Act (ЗДДС)
Art. 96(1) (amended by State Gazette (ДВ) issue 115/2025)
Official Bulgarian text
„Всяко данъчно задължено лице, което е установено на територията на страната, с годишен оборот по чл. 168в за текущата календарна година, който надвиши 51 130 евро, е длъжно в 7-дневен срок от деня, в който е надвишен оборотът, да подаде заявление за регистрация по този закон.“
| Criterion | Old regime (until 31.12.2025) | New regime (from 01.01.2026) |
|---|---|---|
| Threshold | BGN 100,000 | €51,130 (BGN 100,000 at the fixed exchange rate) |
| Period | The last 12 consecutive months | The current calendar year |
| Monitoring | Monthly (on the last day of each month) | Daily (the day the threshold is exceeded) |
| Deadline for the application | Up to 7 days after the end of the month | Up to 7 days from the day the threshold is exceeded |
| Date of registration | 3 days from receipt of the act | The day after the threshold is exceeded (Art. 103) |
| Turnover includes | Taxable supplies and certain exempt supplies | Annual turnover under Art. 168в (extended scope) |
Caution
Annual turnover under Art. 168в: what is included and what is not
The new Art. 168в ЗДДС introduces the concept of “annual turnover” („годишен оборот“), which replaces the previous “taxable turnover” when determining the obligation to register. The difference is not only terminological: the scope of the supplies included has been significantly widened.
Value Added Tax Act (ЗДДС)
Art. 168в(1)
Official Bulgarian text
„Годишният оборот е сума от данъчните основи на извършените от данъчно задълженото лице облагаеми доставки, включително доставките с нулева ставка; доставките, освободени по чл. 40, 42, 43, 44, 45, 47 и 48; доставките на застрахователни и финансови услуги по чл. 46; доставките на недвижими имоти - с изключение на съпътстващите доставки.“
Components of the annual turnover under Art. 168в
Taxable supplies, including zero-rated ones (Art. 168в(1), item 1)*
Exempt supplies under Art. 40, 42-45, 47-48 (health, education, social and others)*
Insurance and financial services under Art. 46*
Supplies of real estate (NEW: item 5), excluding ancillary supplies*
Advance payments received (Art. 168в(8))*
* Mandatory documents
The critical change is the inclusion of exempt supplies of real estate (item 5). Under the old regime, exempt supplies of property (for example the sale of an “old” residential property under Art. 45 ЗДДС) were not included in the taxable turnover. They are now part of the annual turnover, which means that a one-off sale of a property can lead to the threshold being exceeded and an obligation to register.
Important
Art. 168в(2), item 2 excludes from the annual turnover supplies of long-term assets used by the person in their activity. This is a deliberate safeguard against situations in which an enterprise sells production equipment or a company car and is forced to register because of the one-off transaction.

The Small Enterprises Scheme in Bulgaria (Art. 168д)
The new Chapter Nineteen “a” of the ЗДДС introduces the Small Enterprises Scheme (РМП), which is conceptually different from the previous “non-registration”. Instead of simply not charging VAT because it is not registered, the person applies a special scheme with defined obligations and restrictions.

Art. 168д(1)
Official Bulgarian text
„Данъчно задължено лице, което е установено на територията на страната и чийто годишен оборот по чл. 168в за текущата и за предходната календарна година не надвиши 51 130 евро, може да прилага режима за малки предприятия.“

Attention should be paid to three scenarios in which the scheme ends: (1) mandatory registration when the threshold is exceeded; (2) voluntary registration at the person’s choice; (3) moving to the Small Enterprises Scheme in the EU. On ending under item 1, registration takes effect from the day after the threshold is exceeded, and the person must charge VAT from that date.
The Small Enterprises Scheme in the EU (Art. 168е-168к)
This is the genuinely new element introduced by Directive 2020/285: a cross-border VAT exemption. For the first time a Bulgarian enterprise can benefit from an exemption in another member state without being established there, if it meets three cumulative conditions.
| Condition | Description | Threshold/Requirement |
|---|---|---|
| 1. EU turnover | Annual turnover in the whole EU for the current and the previous calendar year | Does not exceed €100,000 |
| 2. National threshold | Annual turnover in the particular member state in which the exemption is sought | Does not exceed the threshold of that state |
| 3. Eligible supplies | Only supplies of goods and services that would be exempt if the person were established in that state | Depends on national legislation |
When applying the scheme the person receives an identification number with the suffix “-EX” (for example BG123456789-EX), has an obligation to report quarterly through an electronic portal (Art. 168н ЗДДС) and cannot combine the scheme with the OSS (One Stop Shop) or the import scheme under Art. 168б.
Caution
Specific schemes: tour operators, dealers and investment gold
A change that stayed outside the focus of most publications but has significant practical impact: when determining the annual turnover for the purposes of the threshold, persons applying special schemes (Art. 142а for tour operators, Art. 149 for dealers in second-hand goods, Art. 162а for investment gold) now include the full amount received, not just the margin.
Example: tour operator
Sales revenue
Total amount received from customers
BGN 200,000
Costs of directly related goods/services
Hotels, transport and so on
BGN 170,000
Margin (old regime = turnover)
Below the old threshold: no registration
BGN 30,000
New turnover for the purposes of the threshold
The full amount: well above BGN 100,000
BGN 200,000
BGN 200,000
instead of BGN 30,000: the new turnover for the purposes of the threshold for tour operators
This is critical information for legal advisers whose clients work in the tourism sector, trade in works of art or deal in investment gold. Many of them may not realise that they have already become liable to register when the act came into force.
Old and new: comparison of the schemes
| Aspect | Until 31.12.2025 | From 01.01.2026 |
|---|---|---|
| Threshold | BGN 100,000 (fixed in leva) | 51,130 EUR (fixed in euro) |
| Monitoring | Monthly, rolling 12 months | Daily, calendar year |
| Deadline for registration | 7 days from the end of the month | 7 days from the day the threshold is exceeded |
| Date of registration | 3 days from the NRA’s act | The day after the threshold is exceeded |
| Scheme below the threshold | Simply not being registered | Small Enterprises Scheme (РМП) |
| Cross-border exemption | Does not exist | EU Small Enterprises Scheme (Art. 168е) |
| Special schemes (turnover) | Margin = turnover | Full amount received = turnover |
| Turnover from real estate | Not included (exempt) | Included (excluding ancillary supplies) |
Practical advice for legal advisers
The changes to the ЗДДС call for a proactive approach to VAT advice. The following checklist covers the key steps when reviewing a client’s VAT exposure.
8-step process for reviewing VAT exposure
Recalculate the 2025 turnover under the new rules of Art. 168в (including real estate and advance payments)*
Check whether the client applies a special scheme (tour operator, dealer) and recalculate with the full amount*
Assess whether there is an obligation to register under § 63 of the transitional provisions (7-day period from 01.01.2026)*
Analyse whether the Small Enterprises Scheme (Art. 168д) is more advantageous than voluntary registration for the particular client*
For EU activity: assess whether the EU Small Enterprises Scheme (Art. 168е) is applicable and advantageous compared with registration under Art. 97а*
Set up a system for daily monitoring of turnover (monthly reporting is no longer enough)*
Update invoices and accounting software for the new schemes and identification numbers (-EX)*
Check the quarterly reporting obligations when applying the EU scheme (Art. 168н)*
* Mandatory documents
7 days
Deadline for filing the application for registration from the day the threshold is exceeded under Art. 96(1) ЗДДС. Under the transitional rules (§ 63) the period runs from 1 January 2026.
Missing this deadline leads to VAT being charged for the period from the date on which registration should have taken effect
Important
- Relying on the old 12-month period instead of the calendar year
- Leaving out exempt supplies of property when calculating turnover
- Not counting advance payments in the annual turnover
- Using the margin instead of the full amount under special schemes
- Missing the 7-day deadline (it is no longer counted from the end of the month)
