Appeals in Bulgarian civil cases: deadline and contents (2026)

Pravko24 July 202613 min

Two-week appeal deadline, contents under Art. 260, annexes under Art. 261 and the rules on new evidence under Art. 266 of the Civil Procedure Code (ГПК).

Appeal proceedings (въззивно производство) under the Civil Procedure Code (ГПК) in force are proceedings of a limited, incomplete appeal review. The appeal court is bound by what the appeal states, and the parties are precluded from introducing new facts and evidence outside the narrow exceptions in the law. In that situation, drawing up the appeal correctly, on time and with the required contents is not a formality but a decisive moment for the outcome of the second hearing of the dispute.

This analysis sets out the rules in Arts 258-273 ГПК (Chapter Twenty) with the verified text of the key provisions and practical checklists for lawyers. The aim is a quick professional reference: the time limit, the required contents, the annexes, the rules on evidence and the scope of the appeal review in one place. For a wider context on appeals under the ГПК, see also our general overview of the interpretative case law of the Supreme Court of Cassation (ВКС) in civil cases.

❓What is the time limit for filing an appeal under the Civil Procedure Code?

✅The appeal (въззивна жалба) is filed within a two-week time limit from the service of the first-instance judgment on the party, and through the court that issued the judgment, not directly to the appeal court (Art. 259(1) ГПК). Judgments of the district courts (районни съдилища) are appealed to the regional courts (окръжни съдилища), and those of the regional courts as a court of first instance to the courts of appeal (апелативни съдилища) (Art. 258 ГПК).

2 weeks

The time limit for filing an appeal, which runs from the service of the first-instance judgment on the party (Art. 259(1) ГПК). The appeal is lodged through the court that issued the judgment.

Missing the time limit makes the appeal inadmissible. Reinstatement is possible only under Art. 64 ГПК and the following articles, in case of special unforeseen circumstances.

The legal framework: jurisdiction and time limit

The starting point is the pair of provisions that determine before which court and within what time limit an appeal is brought. The competent appeal court is determined by the rank of the court that issued the judgment, and the start of the time limit is tied not to the issuing of the judgment but to its service on the party.

Civil Procedure Code (ГПК)

Art. 258

The provision defines the subject of the appeal (a first-instance judgment that has not yet come into force) and the functional jurisdiction of the appeal instance according to the rank of the deciding court.

Official Bulgarian text

„Решенията на районните съдилища подлежат на обжалване пред окръжните съдилища, а решенията на окръжните съдилища като първа инстанция - пред апелативните съдилища.“

Civil Procedure Code (ГПК)

Art. 259(1)

The two-week time limit runs from service, not from the issuing of the judgment. The appeal is filed through the first-instance court, which checks it for regularity and processes it. Paragraphs 2 to 4 govern the suspension and interruption of the time limit on an application for legal aid.

Official Bulgarian text

„Жалбата се подава чрез съда, който е постановил решението, в двуседмичен срок от връчването му на страната.“

Contents of the appeal (Art. 260 ГПК)

Art. 260 ГПК lists the elements that the appeal must contain. Central among them is the statement of what the defect in the judgment consists of: it outlines the subject of the appeal review, because on correctness the court is limited precisely by what the appeal states. An incomplete or blanket statement of the defects narrows the scope of the defence.

Required contents of the appeal under Art. 260 ГПК

The mandatory contents that the appeal must cover to be regular.

Name and address of the party filing the appeal*

Identification of the judgment appealed*

A statement of what the defect in the judgment consists of*

A key element: it determines the scope of the appeal review on correctness

What the request to the appeal court consists of*

Newly discovered and newly arisen facts and an indication of the new evidence (under the conditions of Art. 266)*

The appellant’s signature*

The annexes under Art. 261 ГПК*

* Mandatory

The elements under Art. 260 are supplemented by the mandatory annexes under Art. 261 ГПК. A missing annex is an irregularity that can be remedied under Art. 262 ГПК, but there remains a risk of missing the time limit if you do not react in time.

Civil Procedure Code (ГПК)

Art. 261

The following are attached to the appeal: copies of it and of the annexes according to the number of opposing parties; a power of attorney, where the appeal is filed by an attorney; the new written evidence referred to in the appeal; and a document for the state fee paid, where one is due.

Review and return of the appeal (Art. 262 ГПК)

After the appeal is received, the first-instance court checks it for regularity and admissibility. Where irregularities are found, the party is given a one-week time limit to remedy them. Lateness and failure to remedy the irregularities are the two grounds for returning the appeal.

How the review under Art. 262 ГПК proceeds

1

Receipt and check for regularity

The first-instance court checks whether the time limit has been met and whether the required contents and annexes are present.

2

Instructions on an irregularity

1 week

If the appeal is irregular, the party is notified to remedy the defects.

3

Remedy or return

If the irregularities are remedied in time, the appeal is processed. If it is late or the irregularities are not remedied, the appeal is returned.

4

Appeal against the return

The order returning the appeal can be challenged by a private appeal (частна жалба) to the appeal court.

Civil Procedure Code (ГПК)

Art. 262

If the appeal is irregular, the party is notified to remedy the irregularities within a one-week time limit. There are two grounds for return: filing after the time limit and failure to remedy the irregularities within the time limit given.

Official Bulgarian text

„Разпореждането за връщане може да се обжалва с частна жалба.“

A missed time limit is fatal

The two-week time limit under Art. 259(1) ГПК is preclusive. An appeal filed after it is inadmissible and is returned, and the order returning it can be challenged by a private appeal. Check the date of service from the acknowledgement of receipt, not the date the judgment was issued: this is the most common source of error in calculating the time limit.

Response and cross-appeal (Art. 263 ГПК)

Once the appeal has been processed, a copy of it is served on the opposing party, which has a two-week time limit to file a response. Within the same time limit it can also lodge a cross-appeal (насрещна въззивна жалба), if it has its own interest in challenging the judgment. The regularity of the cross-appeal is checked under Art. 262 ГПК.

Civil Procedure Code (ГПК)

Art. 263

The opposing party can, within two weeks of receiving a copy of the appeal, file a response and present its evidence. A cross-appeal is filed within the same time limit, and its fate follows that of the appeal if the latter is withdrawn or returned.

Official Bulgarian text

„Съдът проверява редовността на насрещната въззивна жалба съгласно чл. 262.“

The exchange of documents in the appeal phase

Service of a copy of the appeal

The first-instance court sends a copy of the appeal and the annexes to the opposing party.

The opposing party’s response

The opposing party files a written response and states its evidence.

2 weeks

Cross-appeal (optional)

Within the time limit for the response, the opposing party can also file its own cross-appeal.

Sending the case to the appeal court

After the time limits expire, the case is processed and sent to the competent appeal instance.

The bar on new facts and evidence (Art. 266 ГПК)

The limited nature of the appeal is clearest in the rules on evidence. As a rule, before the appeal instance the parties cannot cite new facts or present new evidence, because they are precluded by the way the first-instance proceedings developed. The exceptions are exhaustively set out and are interpreted narrowly.

Civil Procedure Code (ГПК)

Art. 266

Para. 1 sets out the principle: the parties cannot introduce new facts and evidence. Para. 2 allows exceptions: facts and evidence that the party could not learn of, state and present in time (item 1), and circumstances that arose after the appeal was filed (item 2). Para. 3 allows evidence that the first-instance court did not admit because of a procedural violation it committed.

Justify why the evidence is admissible

Relying on an exception under Art. 266(2) or (3) ГПК requires an express justification already in the appeal or the response: why the fact is newly learned or newly arisen, or which procedural violation of the first instance prevented the evidence from being collected. A bare request to collect new evidence, without stating the statutory exception, is as a rule refused.

Powers of the appeal court (Arts 269-272 ГПК)

The court’s review of its own motion is not unlimited in scope. It examines of its own motion only the validity of the judgment and its admissibility in the part appealed, whereas on correctness it is bound by what the appeal states. This distinction underlies the concept of the limited appeal under the ГПК in force.

Civil Procedure Code (ГПК)

Art. 269

The provision outlines the two-tier nature of the appeal review: of the court’s own motion on validity and admissibility, limited by the appeal on correctness. The scope was developed further by the interpretative case law of the ВКС.

Official Bulgarian text

„Въззивният съд се произнася служебно по валидността на решението, а по допустимостта - в обжалваната му част. По останалите въпроси той е ограничен от посоченото в жалбата.“

The binding guidance on the scope of Art. 269 ГПК is contained in the interpretative case law of the Supreme Court of Cassation. The foundational decision is Interpretative Decision No. 1/2013 of the General Assembly of the Civil and Commercial Chambers (ОСГТК) of the ВКС, which distinguishes the review of validity and admissibility that the court carries out of its own motion from the limited review of correctness, and which remains binding on the courts today.

in interpretative case No. 1/2013 (9 December 2013)

A foundational interpretative decision on the scope of the appeal review under Art. 269 ГПК in a limited (incomplete) appeal. It distinguishes the review of validity and admissibility, which is carried out of the court’s own motion, from the review of correctness, which is limited by what the appeal states. In deciding the dispute on the merits, the appeal court is also bound by the prohibition on making the appellant’s position worse (reformatio in peius), where the judgment has not been appealed by the opposing party. When it upholds the first-instance judgment, the court can give reasons for its decision by referring to the reasons of the first instance.

Civil Procedure Code (ГПК)

Art. 271

The prohibition on reformatio in peius protects the appellant against having their position made worse on their own appeal. It falls away if the opposing party has also appealed the judgment.

Official Bulgarian text

„Ако решението не е обжалвано от другата страна, положението на жалбоподателя не може да бъде влошено с новото решение.“

Civil Procedure Code (ГПК)

Art. 272

Referring to the reasons of the first instance is permitted only when the judgment is upheld, and it does not release the appeal court from the duty to discuss the relevant arguments in the appeal.

Official Bulgarian text

„Когато въззивният съд потвърди първоинстанционното решение, той мотивира решението си, като може да препрати и към мотивите на първоинстанционния съд.“

Practical tips for lawyers

An appeal most often fails not on the merits but because of procedural omissions: a missed time limit, an incompletely stated defect, or an unjustified attempt to introduce new evidence. The following checklist sums up the critical checks before lodging.

Checklist before lodging an appeal

Check every point before you file the appeal through the first-instance court.

0/6

The two-week time limit has been met, calculated from the date of service shown on the acknowledgement of receipt*

The appeal is filed through the court that issued the judgment, not directly to the appeal court*

The defect in the judgment is stated clearly and specifically for each conclusion challenged*

A request to the appeal court is formulated (set aside, amend, remit)*

Copies, power of attorney, new written evidence and the fee document are attached (Art. 261)*

If new evidence is requested: a justified exception under Art. 266(2) or (3)*

* Mandatory documents

Common mistakes in practice

Three omissions are the most frequent: filing the appeal directly with the appeal court instead of through the court that issued the judgment; a blanket statement of the defect, which narrows the scope of the review under Art. 269 ГПК; and a request to collect new evidence without justifying the exception under Art. 266 ГПК. Also distinguish the appeal (against judgments) from the private appeal (against rulings and orders): the two have different rules and time limits.

Tracking the current wording of the ГПК and the required contents under Arts 260-261 for every appeal is a routine but time-consuming task. A legal assistant such as Pravko can quickly return the relevant provisions and links to the official text on lex.bg, but it does not replace your own professional check of the time limit and contents in the specific case.
