Theft in Bulgaria, Art. 194 Criminal Code: legal analysis

Theft in Bulgaria, Art. 194 Criminal Code: legal analysis

Pravko26 July 202612 min

Theft under Art. 194 of the Bulgarian Criminal Code: when it is completed, the minor case in para. 3, repeat offending and the Art. 218b exit.

Theft under Art. 194(1) of the Criminal Code (НК) is the property offence most often heard in Bulgarian criminal practice, but for that very reason disputes about it rarely turn on the basic text itself. It has stood unchanged since State Gazette (ДВ) issue 10 of 1993, while the framework around it moves: Art. 195(1), item 11 НК was amended by State Gazette issue 61 of 2025, in force from 31 January 2026, and the НК is in the wording as amended by State Gazette issue 55 of 16 June 2026.

This analysis starts from the offence and goes through the four questions that in practice decide the case: is the act completed, is the case a minor one, does the aggravating circumstance hold up, and is there still a crime at all. It sets out in detail the reasoning of two acts of the Supreme Court of Cassation (ВКС) given in reopening proceedings, which are almost absent from the freely available content on the topic.

❓What are the elements of theft under Art. 194(1) НК?

✅Taking another person's movable thing from the possession of someone else, without their consent, with the intention to appropriate it unlawfully. The act is completed only when the offender has established their own actual control over the thing. The penalty is imprisonment of up to eight years, and in minor cases under para. 3, imprisonment of up to one year, probation or a fine of one hundred to three hundred leva.

Source: НК, Art. 194

Legal framework: Art. 194(1) to (3) НК

Theft is placed systematically in Chapter Five, Section I of the Special Part of the НК. The basic offence has four objective elements: taking, another’s movable thing, possession by someone else and lack of consent. To these the law adds a special purpose, which forms part of the subjective side and distinguishes theft from a number of neighbouring offences.

Criminal Code (НК)

Art. 194(1)-(3)

The basic offence, the offender's co-ownership of the thing and the privileged offence for a minor case. Para. 1 has stood unchanged since 1993, para. 3 since 2005.

Para. 2 has independent practical significance in cases of co-ownership and property relations between spouses: the fact that part of the thing belongs to the offender does not exclude the offence. The sanction ranges in the НК in the wording in force are expressed in leva, not in euro, and should be cited as they appear in the law.

The moment of completion: when theft is only an attempt

The distinction between completed theft and attempt is the first question the defence should raise, and at the same time the one most often overlooked. The criterion is not whether the thing has been removed from its place but whether the offender has established their own actual control over it.

Criminal Code (НК)

Art. 18(1)

The general provision on attempt, applicable to all intentional offences, including theft.

Official Bulgarian text

„Чл. 18. (1) Опитът е започнатото изпълнение на умишлено престъпление, при което изпълнителното деяние не е довършено или макар и да е довършено, не са настъпили предвидените в закона и искани от дееца общественоопасни последици на това престъпление.“

In Judgment No. 487 of 24 February 2012 in criminal case No. 2341/2011 of the ВКС, Third Criminal Division the panel holds that classifying the act as a completed offence is unlawful, because at the time of the arrest the offender had not yet established his actual control over the property taken. The sheet metal had been dismantled and prepared for carrying away, but the act was discovered before the convicted person had taken possession of it as his own. The court reclassified the act as an attempt under Art. 18(1) НК.

Checking whether theft is completed

1

Interrupting someone else's possession

The thing is separated from the previous possessor or from the place where he exercises actual control. In itself this does not complete the act.

2

Establishing one's own actual control

The offender gains a real ability to dispose of the thing. This is the moment of completion according to the reasoning of ВКС Judgment No. 487/2012.

3

Arrest before that moment

A thing that has been dismantled and prepared for carrying away, where the arrest comes before possession is established, supports an attempt under Art. 18(1) НК, not completed theft.

4

Effect on the sentence

Incompleteness is a mitigating circumstance of serious relative weight. In the same case the sentence was reduced from two years and six months to two years of imprisonment.

The same act also contains two directions on the individualisation of the sentence that are used less often than they deserve. The first is that the way in which the defendant exercises the rights given to him by law, including the right of defence, cannot be counted as an aggravating circumstance. The second arises from Art. 56 НК.

Criminal Code (НК)

Art. 56

A previous conviction that grounds the classification as repeat offending cannot be counted a second time as an aggravating circumstance.

Official Bulgarian text

„Чл. 56. Не са смекчаващи и отегчаващи обстоятелства тези, които са взети предвид от закона при определяне на съответното престъпление.“

The nature of the case law cited

Both ВКС acts examined in this analysis were given in proceedings for the reopening of criminal cases, not under the cassation procedure. They are case-specific, not binding, case law within the meaning of Art. 130(2) of the Judiciary Act (ЗСВ). The solutions contained in them have persuasive but not binding force for the lower courts.

The subjective side: the intention to appropriate unlawfully

Theft is committed with direct intent combined with a special purpose. The offender must be aware that the thing is another’s and that he is taking possession without consent, and must pursue appropriation, that is, establishing lasting actual control of the kind the owner has.

❓Can there be theft without an intention to appropriate?

✅No. The absence of an intention to appropriate excludes the offence under Art. 194 НК even where the taking has occurred. The act may constitute an offence under another provision, for example self-help (самоуправство), but not theft.

Source: НК, Art. 194(1)

The practical significance is most tangible in the temporary use of another’s thing and in taking carried out to settle a disputed right by force. In both situations the examination of the purpose, not of the act, determines the classification. The distinction from fraud under Art. 209 НК runs along a different line: in theft possession is taken, whereas in fraud it is handed over voluntarily by a deceived victim.

A minor case under Art. 194(3) in connection with Art. 93, item 9 НК

Minor character is not a separate discretionary assessment by the court but the application of a legal definition. It is contained in the General Part of the НК and sets two alternative reference points: the absence or insignificance of harmful consequences, or the presence of other mitigating circumstances.

Criminal Code (НК)

Art. 93, item 9

The legal definition, applicable to all offences that provide for a minor case, including Art. 194(3) НК.

Official Bulgarian text

„9. "Маловажен случай" е този, при който извършеното престъпление с оглед на липсата или незначителността на вредните последици или с оглед на други смекчаващи обстоятелства представлява по-ниска степен на обществена опасност в сравнение с обикновените случаи на престъпление от съответния вид.“

The value of the object is not the only criterion. In Judgment No. 102 of 13 March 2014 in criminal case No. 2093/2013 of the ВКС, Second Criminal Division the panel weighs everything together: a value of BGN 60, return of the thing before pre-trial proceedings were opened, a banal manner of commission, a single second-hand item, a confession that led to the discovery of the act, rehabilitation by operation of law for the previous conviction and lack of employment. The conclusion is a markedly lower degree of public danger within the meaning of Art. 93, item 9 НК.

Three institutions are often confused in the defence, although they lead to different consequences. The table below distinguishes them.

Aggravating circumstances and their limits

Art. 195(1) НК contains twelve aggravating circumstances. Practical disputes concentrate on two of them, and a third has been amended very recently.

Criminal Code (НК)

Art. 195(1), item 4

The archaic form използувано is the authentic wording of the law and is quoted verbatim.

Official Bulgarian text

The interpretation of the concept of technical means is derived from Decree No. 6 of 26 April 1971 of the Plenum of the Supreme Court (ППВС) in criminal case No. 3/71, Section II, item 11: the aggravation applies when the offender used a forged key or a key not intended for unlocking the particular premises. In Judgment No. 102/2014 the ВКС refuses to apply item 4, because the key used had been found hanging on the inner side of the gate and was intended precisely for unlocking it. Such a key is neither a technical means nor a special manner of commission.

Criminal Code (НК)

Art. 195(1), item 7

Repeat offending aggravates only in non-minor cases, which puts the minor case before repeat offending in the order of examination.

Official Bulgarian text

From this follows the conclusion on which the whole of Judgment No. 102/2014 rests. Classifying the offence as a minor case logically leads to the falling away of the aggravating circumstance under Art. 195(1), item 7 НК. At the same time the court holds that the act is not insignificant under Art. 9(2) НК, that is, the offence remains but loses its aggravating feature.

Repeat offending itself is regulated in the General Part, and the conditions for its falling away are in a separate provision that is overlooked in practice.

Criminal Code (НК)

Art. 28(1) and (2)

Official Bulgarian text

„Чл. 28. (1) Предвиденото в особената част на този кодекс наказание за престъпление, извършено повторно, се налага, ако деецът е извършил престъпление, след като е бил осъден с влязла в сила присъда за друго такова престъпление. (2) Тази разпоредба се прилага и когато се касае за еднакви по вид престъпления против обществената и личната собственост.“

Criminal Code (НК)

Art. 30(1)

The provision that determines when repeat offending falls away, and which expressly states the opposite of the widespread view about rehabilitation.

Official Bulgarian text

„Чл. 30. (1) Правилата на чл. 28 и 29 не се прилагат, ако са изтекли пет години от изтърпяване на наказанието по предишните присъди. Реабилитацията в този срок не изключва тяхното прилагане.“

Rehabilitation does not exclude repeat offending

The second sentence of Art. 30(1) НК states literally that rehabilitation within the five-year period does not exclude the application of Arts. 28 and 29 НК. Repeat offending falls away only after five years have passed since the penalty under the previous sentences was served. In Judgment No. 102/2014 the ВКС expressly holds that the act was committed within the period under Art. 30(1) НК despite rehabilitation by operation of law, and Art. 28 НК is not applied solely because the conditions of Art. 93, item 9 НК are met. The argument for the falling away of the aggravation under Art. 195(1), item 7 НК is therefore the minor case, not rehabilitation.

Separately, item 11 of Art. 195(1) НК should be followed, which was amended by State Gazette issue 61 of 2025, in force from 31 January 2026. The referring provision and the provisions it refers to enter into force together, which means that the aggravation applies only to acts committed after that date.

Criminal Code (НК)

Art. 195(1), item 11

The most recent amendment among the aggravated forms of theft. Art. 114м, Art. 114о and Art. 114р are new by the same State Gazette issue 61 of 2025.

Official Bulgarian text

Art. 218б НК: when theft stops being a crime

Art. 218б НК provides an administrative exit from criminal liability for certain low-value property acts. The provision applies only where the positive conditions of para. 1 are cumulatively met and none of the negative conditions of para. 2 is present.

Criminal Code (НК)

Art. 218б(1)

The value threshold is assessed at the date the act was committed, not at the date of the hearing.

Official Bulgarian text

„За деяния по чл. 194, ал. 3 , чл. 195, ал. 4 , чл. 204, буква "а" , чл. 206, ал. 1 и 5 и чл. 207 и за вещно укривателство във връзка с тях, когато стойността на предмета е до размера на две минимални работни заплати за страната, установени към датата на извършване на деянието, наказанието е глоба от сто до триста лева, налагана по административен ред, ако предметът на престъплението е възстановен или заместен.“

Cumulative conditions under Art. 218б НК

Derived from the text of the provision and from the reasoning of ВКС Judgment No. 102/2014.

The act falls within the listed offences, including theft in a minor case under Art. 194(3) НК*

The value of the object is up to two minimum wages for the country at the date the act was committed*

The object of the offence has been restored or replaced*

The offender has not committed, within one year, two or more acts with a total value of the object above one hundred and fifty leva*

Negative condition under para. 2, item 1

The offender has not been convicted of such an offence and has not been given an administrative penalty for such an act where a year has not passed since it was committed*

Negative condition under para. 2, item 2

The object of the act is not a weapon, ammunition for a firearm, explosive, poisonous or narcotic substances, pyrotechnic articles, or military and other special equipment*

Negative condition under para. 2, item 3

* Mandatory

The sanction consequences differ substantially depending on how far the classification goes. The values below are in leva, as expressed in the law in the wording in force.

Sanction ranges for theft of a low-value thing

Art. 194(1) НК: basic offence

imprisonment of up to eight years

Art. 194(3) НК: minor case

imprisonment of up to one year, probation or a fine of one hundred to three hundred leva

Art. 197, item 2 НК: thing returned or replaced in a minor case

Applies if the thing is returned before the close of the judicial inquiry in the first-instance court

probation or a fine of one hundred to three hundred leva

Art. 218б(1) НК: administrative procedure

The act is not a crime; liability is enforced under the Administrative Violations and Sanctions Act (ЗАНН)

a fine of one hundred to three hundred leva

Total

Different outcomes depending on the classification

The sanctions are alternatives and are not added together. The amounts are quoted in leva, as they appear in the wording of the НК as amended by State Gazette issue 55 of 16 June 2026.

The procedural consequence where the conditions of Art. 218б НК are present is acquittal. In Judgment No. 102/2014 the ВКС sets aside the sentence and acquits the convicted person under Art. 425(1), item 2, second alternative, in conjunction with Art. 24(1), item 1 of the Criminal Procedure Code (НПК), within the factual findings of the sentence that had entered into force.

Criminal Procedure Code (НПК)

Art. 425(1), item 2

The power of the reopening court, used in the operative part of Judgment No. 102/2014.

Official Bulgarian text

Who imposes the administrative penalty

The competent authority is not the prosecution service. Under Art. 424(5) НК, the fine under Art. 218б is imposed by a penal decree of the mayor, on the basis of materials sent to him by the prosecutor, or of a report from the administration of the enterprise or the institution or from the supervisory bodies. Where the violation has been found by the bodies of the Ministry of the Interior, the penal decree is issued by the Minister of the Interior or a person authorised by him. The prosecutor is an intermediate link, not a sanctioning authority. The provision is in the transitional and final provisions of the НК, not in the НПК.

The status of the interpretative case law on theft

The main interpretative act on theft remains ППВС No. 6 of 26 April 1971 in criminal case No. 3/71 of the Plenum of the Supreme Court. It is often misstated: there are claims that the decree has been repealed in full. This is not so.

Section III only

the part of ППВС No. 6/1971 declared no longer in force by ТР No. 1 of 24.01.2022 in interpretative case No. 1/2018 of the General Assembly of the Criminal Chambers (ОСНК) of the ВКС, Section I, item 16

Source: Interpretative Decision No. 1 of 24 January 2022 of the ОСНК of the ВКС

The operative part of Interpretative Decision No. 1 of 24 January 2022 in interpretative case No. 1/2018 of the ОСНК of the ВКС declares a list of interpretative acts no longer in force, and under No. 16 it names Section III of the decree. Section II remains in force, and with it the two items that bear directly on theft: item 7 on the minor case and item 11 on technical means. It is on these that Judgment No. 102/2014 relies.

A reservation in the reasoning of ТР No. 1/2022

The reasoning of the interpretative decision accepts that the guidance in the decree is current today, but at the same time notes that it was issued under a different constitutional order, which distinguished public from personal property, and that this circumstance must be taken into account when applying it. Relying on ППВС No. 6/1971 therefore also requires an assessment of conformity with the constitutional framework in force.

The distinction between kinds of case law has direct procedural significance. Interpretative decisions of the ОСНК are binding on the judicial and executive authorities. Decisions in specific cases, including those in reopening proceedings, bind only the parties to the case and serve as an argument, not as a basis.

Distinctions: embezzlement, returning the thing, the family circle

The most common exercise in distinguishing property offences is between theft and embezzlement (обсебване). The decisive criterion is the offender’s factual position in relation to the thing before the act.

Applicability of Art. 218б НКYes, in a minor case under para. 3Yes, under paras. 1 and 5

Returning the thing has independent significance outside Art. 218б НК as well. The mitigating regime under Art. 197 НК applies to a wider range of situations and is tied to a procedural moment.

Criminal Code (НК)

Art. 197

An extract from items 1 and 2. The provision contains five items, corresponding to the individual offences.

Official Bulgarian text

„Чл. 197. Ако до приключване на съдебното следствие в първоинстанционния съд откраднатата вещ бъде върната или заместена, наказанието е: 1. в случаите на чл. 194, ал. 1 - лишаване от свобода до пет години; 2. в случаите на чл. 194, ал. 3 и 195, ал. 4 - пробация или глоба от сто до триста лева;“

The last often-overlooked situation is the procedural bar for acts within the family circle. Where the stated relationships exist, public-prosecution criminal proceedings are inadmissible without a complaint from the victim.

Criminal Code (НК)

Art. 218в, item 2

Prosecution is initiated on the victim's complaint. The check is procedural and comes before any discussion of the elements of the offence.

Practical conclusions for the defence

The order of examination is not a formality. Each next step makes sense only if the previous one gave a negative result, and the reverse order leads to accepting classifications that do not hold up.

Order of examination in a theft case

A sequence drawn from the structure of the law and from the reasoning of the acts examined.

0/9

Procedural admissibility: is the victim within the circle under Art. 218в, item 2 НК, and is there a complaint*

Elements of the offence: are the four objective elements and the intention to appropriate present*

Completion: has the offender established their own actual control over the thing, or is the act an attempt under Art. 18(1) НК*

Minor case: has the whole set of circumstances under Art. 93, item 9 НК been examined, and not just the value*

Aggravating circumstance: exactly what key or means was used, before Art. 195(1), item 4 НК is accepted*

Repeat offending: have the five years under Art. 30(1) НК passed, and separately, does the minor case cause Art. 195(1), item 7 НК to fall away*

Rehabilitation within the five-year period does not exclude the application of Art. 28 НК

Decriminalisation: are all the conditions under Art. 218б(1) met and are the negative conditions under para. 2 absent*

Mitigating regime: is Art. 197 НК applicable where the thing is returned or replaced*

Individualisation: is a circumstance already taken into account in the classification not being counted a second time under Art. 56 НК*

* Mandatory documents

The moment the thing is restored

The two regimes have different time limits. Art. 218б(1) НК requires the object to be restored or replaced, and in the case examined by the ВКС this happened even before the pre-trial proceedings were opened and also weighed in the assessment of the minor case. Art. 197 НК allows return or replacement up to the close of the judicial inquiry in the first-instance court. The earlier the restoration takes place, the more institutions remain available.

For the practising defence lawyer, the main value of the two acts examined is that they show how one and the same set of facts moves through four successive reductions: from aggravated theft to the basic offence, from the basic offence to a minor case, from a minor case to an administrative violation, and, where the act is incomplete, from a completed act to an attempt. Each of these movements has its own legal basis and its own burden of proof. A similar logic of layered examination applies to other offences in the Special Part, including Art. 313 НК.
