Fraud (Art. 209 НК) in Bulgaria: elements and case law

Analysis of fraud under Art. 209 НК: elements, intent, the line from civil fraud, aggravated offences and current Supreme Court of Cassation practice.

Fraud under Art. 209 of the Criminal Code (НК) is one of the most frequently charged economic crimes and at the same time one of those that most often end in acquittal on cassation (the final review by the Supreme Court of Cassation, ВКС). The reason is that the line between a failed deal and criminally relevant fraud runs through an element that is hard to prove: the moment intent is formed. Errors on the mental element and an unprofessional distinction from the civil tort lead to cases being sent back for a new hearing in a number of ВКС decisions.

We analyse systematically the elements of the offence, the distinction from misappropriation (обсебване) and from civil fraud under Art. 29 of the Obligations and Contracts Act (ЗЗД), the aggravated offences under Art. 210, 211, 212, 212а and 213 НК, and the key procedural traps that decide the outcome of a typical case under Art. 209 НК.

❓What are the elements of fraud under Art. 209(1) НК?

✅Fraud under Art. 209(1) НК requires, cumulatively: (1) inducing or maintaining a mistaken belief in the victim; (2) as a result of which the victim disposes of property; (3) which causes pecuniary loss to them or to a third party. On the mental side it requires direct intent and a special purpose of obtaining a pecuniary gain, both present already at the time the victim is misled. The penalty is imprisonment from one to six years.

Legal framework: Art. 209 НК

Fraud is regulated in Section IV of Chapter V of the Special Part of the Criminal Code (НК), devoted to crimes against property. The protected interest is both ownership and property rights in the broader sense, including claims and opportunities to realise money gains. The basic offence under Art. 209(1) НК covers the active form, while paragraph 2 regulates the passive form and paragraph 3 introduces a privileged (mitigated) offence for minor cases.

Art. 209(3)

Official Bulgarian text

The systematic placement of Art. 209 НК in Section IV matters for the legal classification: the provisions from Art. 210 to Art. 213 НК (aggravated and special offences) apply only if the elements of the basic offence under Art. 209 НК are present. Without the basic features, the prosecutor cannot bring a charge under an aggravated offence without first proving that there is fraud within the meaning of Art. 209 НК. The link with Art. 206 НК (misappropriation, обсебване) and Art. 207 НК (appropriation of another’s property) works the other way round: the distinguishing criteria mark out the limits of application of Art. 209 НК itself.

The objective side: the three elements of the offence

The objective side of fraud under Art. 209(1) НК requires three cumulatively present elements, whose successive occurrence forms the factual make-up of the offence. The absence of any one of them rules out classification as fraud, even where the conduct is clearly immoral or unfair.

The sequence of the elements of fraud under Art. 209(1) НК

1

Inducing or maintaining a mistaken belief

The perpetrator communicates false facts, conceals material circumstances or reinforces existing wrong impressions in the victim. The mistaken belief must concern circumstances that are essential to the victim’s decision to dispose of their property.

2

Disposition of property by the victim

The victim voluntarily carries out an act of disposing of their own or another’s property (payment, transfer, handing over, taking on an obligation). Voluntariness is the key difference from theft, where the taking is without consent.

3

Pecuniary loss

As a result of the disposition, there is a reduction in the assets of the victim or a third party. The offence is result-based: it is considered completed at the moment the loss occurs, not when the deal is concluded.

There must be an unbroken causal link between the three elements: the mistaken belief must have led to the disposition, and the disposition to the loss. An interruption of this chain by an intervening event (for example the victim’s own mistake, independent of the misleading) rules out the offence, even when the perpetrator acted with fraudulent intent.

The subjective side: direct intent and a special purpose

The subjective side is the most sensitive element of Art. 209 НК and is usually where cases are won or lost on cassation. Direct intent is required, covering all elements of the objective side, together with a special purpose of obtaining a pecuniary gain for oneself or for another, expressly set out in the text of the law.

❓What must the prosecution prove on the subjective side of Art. 209 НК?

✅The prosecution must establish that at the time of misleading, the perpetrator was aware that they were creating a wrong impression in the victim, that this impression would motivate the victim to dispose of their property, and that pecuniary loss would result. In addition, there must be the special purpose of obtaining a pecuniary gain, which does not coincide with the usual business interest in a deal that can be performed. Indirect intent is not sufficient: fraud cannot be committed with eventual intent.

Source: НК, Art. 11(2)

Trap: the moment intent is formed

Where the intent not to perform is formed after the property is received, there is no fraud, but possibly misappropriation under Art. 206 НК or a breach of contract under civil law. This is the most common source of acquittals in cases under Art. 209 НК. The defence systematically attacks the chronology: if at the time of the deal the perpetrator had a real ability and intention to perform, the later inability or unwillingness is not fraud.

The subjective side is established indirectly, by analysing objective circumstances: the perpetrator’s conduct before, during and after the deal, their financial means, their statements to third parties, the repetition of similar schemes. The ВКС consistently requires the prosecution to build a separate line of evidence on the subjective side, and not to derive it automatically from objective non-performance.

Active (para. 1) and passive (para. 2) fraud

The distinction between the active and the passive form of fraud matters both for classification and for determining the penalty. The difference is whether the perpetrator themselves creates or maintains the mistaken belief (para. 1), or merely takes advantage of an existing one (para. 2).

CriterionActive fraud (para. 1)Passive fraud (para. 2)
The actInducing or maintaining a mistaken beliefUsing an existing mistaken belief, inexperience or lack of knowledge
Conduct of the perpetratorActive: communicating false facts or reinforcing wrong impressionsPassive use, without creating a new impression
Evidentiary focusEstablishing the specific false statementsEstablishing knowledge of the other person’s mistaken belief or inexperience and conscious use of it
PenaltyImprisonment from 1 to 6 yearsImprisonment up to 5 years
Minor case (para. 3)Imprisonment up to 1 year or probationImprisonment up to 1 year or probation

Comparison of active and passive fraud under Art. 209 НК

In practice, passive fraud requires more careful proof, because an uninformed or inexperienced victim did not always get their mistaken belief from the perpetrator. The prosecution must establish that the perpetrator knew of the other person’s mistaken belief, inexperience or lack of knowledge, and that they consciously used this weakness to obtain a pecuniary gain. Simply benefiting from a deal that is advantageous to the perpetrator, without knowing about the other party’s mistaken belief, is not passive fraud.

The distinction from civil fraud under Art. 29 ЗЗД

One of the key professional skills in defending fraud cases is correctly distinguishing criminal fraud under Art. 209 НК from civil fraud under Art. 29 ЗЗД. The two regimes address similar factual conduct, but they have different consequences and evidentiary requirements, which often overlap in practice.

Criminal fraud (Art. 209 НК) and civil fraud (Art. 29 ЗЗД)

Breach of contract is not fraud

Ordinary non-performance of a contractual obligation, even where the debtor acts in bad faith, is not a crime under Art. 209 НК. The ВКС consistently distinguishes a fraudulent promise (made with prior intent not to perform) from a promise left unperformed (through later inability or unwillingness). Attempts to criminalise commercial risk or a failed deal are among the most frequent grounds for acquittals on cassation.

Aggravated and special offences

Where the basic offence under Art. 209 НК is made out, the legislator provides a number of aggravated (квалифицирани) and special offences that increase liability when additional circumstances are present. Applying them correctly requires a separate analysis of the features that qualify them.

Overview of the penalties for the aggravated offences

Current ВКС case law

The case law of the Supreme Court of Cassation on Art. 209 НК in recent years has concentrated on three recurring problems: correctly establishing the subjective side, the distinction from misappropriation, and the assessment of the body of evidence in complex economic schemes. Here is a landmark decision illustrating the standard of cassation review.

Supreme Court of Cassation (ВКС) decision

Decision No. 188 of 20 April 2012, First Criminal Division (I НО), criminal case No. 476/2012

A cassation decision under Art. 209(1) in conjunction with Art. 20(2) НК (fraud in complicity). The ВКС analyses the assessment of the body of evidence, the credibility of witness testimony, the manifest unfairness of the sentence and the application of a suspended sentence (условно осъждане) under Art. 66 НК.

In the decision cited, the cassation panel stresses the duty of the first instance and appellate courts to discuss all the evidence in its interconnection and to give reasons for the finding of direct intent and complicity. Similar reasoning appears in a number of other decisions in which the ВКС sends cases back for a new hearing because of insufficient discussion of the subjective side or a mismatch between the established facts and the legal classification. A practising lawyer should cite this line systematically when drafting cassation appeals.

The distinction from misappropriation (Art. 206 НК)

One of the most common classification challenges in practice is the distinction between fraud and misappropriation (обсебване). Both offences concern attacks on another’s property, but they differ mainly in the moment criminal intent is formed and in the way the property is obtained.

Criminal Code (НК)

Art. 206

Misappropriation: the perpetrator receives the item lawfully (for example under a loan, deposit or agency agreement) and then unlawfully appropriates it. The intent is formed after the property is received.

Fraud (Art. 209) and misappropriation (Art. 206)

Defence strategies and the prosecution’s burdens

Fraud cases require the defence to take a systematic approach to attacking the subjective side, the body of evidence and the legal classification. The prosecution, for its part, must build a separate line for each element of the offence, without relying on presumptions or automatic conclusions from objective non-performance.

Related offences and concurrence

Art. 209 НК is often applied together with other offences, especially in complex economic schemes or organised criminal activity. Correct classification requires judging whether the separate acts amount to real or ideal concurrence of offences, and whether the application of Art. 26 НК (continuing offence) excludes or combines the separate classifications.

Criminal Code (НК)

Art. 20, Art. 26

Art. 20 НК (complicity), often applied together with Art. 209 НК in frauds committed by a group. Art. 26 НК (continuing offence) applies to a series of similar fraudulent acts united by a common intent and a similar way of commission.

Criminal Code (НК)

Art. 308, Art. 309

Document offences, often together with Art. 212 НК where forged or altered documents are used to obtain funds. Ideal concurrence where drawing up and using the document is an act simultaneous with the fraud.

In ВКС practice there are also concurrences with offences from Chapter VI of the НК (economic offences), especially where the fraud is a means of concealing a larger-scale economic activity. The prosecution must carefully judge whether the separate acts keep a separate legal classification or are absorbed by the broader offence. The defence, on the contrary, often has an interest in arguing ideal concurrence to reduce the effective penalty.

A civil claim in criminal proceedings

In fraud cases the victim may bring a civil claim for compensation under Art. 84 et seq. НПК. This makes it possible to recover the pecuniary loss within the criminal proceedings, without a separate civil case. If the defendant is acquitted under Art. 209 НК, the victim keeps the option of seeking civil liability under Art. 45 ЗЗД or avoidance of the deal under Art. 29 ЗЗД, subject to the relevant limitation and preclusive periods.

Practical takeaways

The analysis of Art. 209 НК shows that the success of a fraud case depends to a significant degree on the quality of the evidentiary analysis of the subjective side. The defence has many legitimate lines of attack, based on the chronology of intent, the distinction from the civil tort and the applicability of mitigating provisions. The prosecution, for its part, must build a separate line of evidence for each element, without relying on automatic conclusions from non-performance. Cassation review under Art. 348 НПК remains an effective means of correcting errors in the legal classification and the assessment of the evidence.
