Bulgarian Supreme Court interpretative decisions: binding force

Bulgarian Supreme Court interpretative decisions: binding force

Pravko4 July 202612 min

What an interpretative decision of the Supreme Court of Cassation is, who adopts it and when, its binding force under Art. 130 ЗСВ, and how to cite it.

The interpretative decision (тълкувателно решение, ТР) is the strongest tool for unifying case law in Bulgaria, but the institution is often confused with ordinary cassation case law and with interpretative rulings (тълкувателни постановления). For a practising lawyer the difference is not academic: relying on the wrong type of act, or on a decision that has lost its force, is a procedural error with real consequences.

This analysis sets out the legal framework under Art. 124-131а of the Judiciary System Act (Закон за съдебната власт, ЗСВ): what an interpretative decision is, who adopts it and when, what its binding force is, and how to find and cite it correctly in proceedings. Every statement is anchored in the current text of the law.

❓What is an interpretative decision of the Supreme Court of Cassation (ВКС) and is it binding?

✅An interpretative decision (ТР) is an act of the general assembly of a chamber or chambers of the Supreme Court of Cassation (ВКС) or of the Supreme Administrative Court (ВАС), which interprets the law where case law is contradictory or incorrect. Under Art. 130(2) ЗСВ, interpretative decisions are binding on the bodies of the judicial and executive power, on the bodies of local self-government and on all bodies that issue administrative acts. Unlike casual cassation case law, a ТР binds everyone (erga omnes).

What an interpretative decision is and why it is binding

An interpretative decision is adopted when the application of a provision has produced contradictory or incorrect practice in the courts. Its aim is to establish a single, binding interpretation of the law which all bodies applying the law must follow from then on. It is precisely this binding force that sets it apart from individual court decisions.

Judiciary System Act (ЗСВ)

Art. 130(2)

This provision gives a ТР binding force towards everyone (erga omnes), and not only between the parties to a specific dispute.

Official Bulgarian text

„Тълкувателните решения и тълкувателните постановления са задължителни за органите на съдебната и изпълнителната власт, за органите на местното самоуправление, както и за всички органи, които издават административни актове.“

It is worth noting a distinction that lawyers most often overlook. A decision of a three-judge panel of the ВКС under Art. 290 of the Civil Procedure Code (ГПК) is binding practice, but only in the specific case: it binds the parties, not an unlimited circle of addressees. An interpretative decision, by contrast, is an abstract interpretative act with binding force for all bodies applying the law.

Who adopts an interpretative decision, and when: Art. 124 ЗСВ

The ground for adopting a ТР is precisely defined: contradictory or incorrect practice in the interpretation and application of the law. The panel that adopts the decision depends on which chamber or chambers of the supreme court are affected.

Judiciary System Act (ЗСВ)

Art. 124(1)

Item 3 (ОСНГТК) was added by State Gazette (ДВ) issue 62 of 2016.

Official Bulgarian text

„При противоречива или неправилна практика по тълкуването и прилагането на закона се приема тълкувателно решение от общото събрание на: 1. наказателната, гражданската или търговската колегия във ВКС; 2. гражданската и търговската колегии във ВКС; 3. (нова - ДВ, бр. 62 от 2016 г.) наказателната, гражданската и търговската колегия във ВКС; 4. колегия във ВАС; 5. колегиите във ВАС.“

item 2General assembly of the civil and commercial chambers (ОСГТК) of the ВКСQuestions common to the civil and commercial chambers

item 4A chamber of the ВАСPractice within one chamber of the ВАС
item 5The chambers of the ВАСQuestions common to the chambers of the ВАС

Alongside interpretative decisions, the ЗСВ also provides for interpretative rulings (тълкувателни постановления). One clarification matters here, and it is often passed on inaccurately. When the contradiction is between the Supreme Court of Cassation and the Supreme Administrative Court, a joint interpretative ruling is adopted. For the Administrative Violations and Sanctions Act (ЗАНН), the law likewise provides for a joint interpretative ruling of the relevant chambers of the ВКС and ВАС, and not for a separate special panel.

Judiciary System Act (ЗСВ)

Art. 124(3)

New paragraph added by State Gazette issue 109 of 2020, in force from 23 December 2021. The mechanism under the ЗАНН is a joint interpretative ruling of the relevant chambers of the ВКС and ВАС, not a separate special panel.

Who can request an ТР: Art. 125 ЗСВ

The circle of persons who can make a request for the adoption of an interpretative decision or ruling is defined exhaustively. The 2020 amendment widened it to include the Council of Ministers and a minister or a collective authority created by law, where they have powers to apply the law concerned.

How a question reaches the general assembly

A party to the case is not among the petitioners under Art. 125 ЗСВ. It can get a question referred to interpretative proceedings only indirectly: when the ВКС panel itself finds questions that have been resolved in contradictory ways, it stays the proceedings and proposes that the general assembly adopt an interpretative decision (Art. 292 ГПК).

The procedure step by step (Art. 126-130 ЗСВ)

Interpretative proceedings follow a strictly defined order. From the receipt of the request to the announcement of the decision, the law sets specific time limits that discipline the process.

1

Filing a reasoned request

An authorised petitioner files a written request stating the disputed provision, the disputed questions and the contradictory court acts that have entered into force (Art. 127 ЗСВ).

2

Opening the interpretative case

The president of the relevant court opens an interpretative case and appoints rapporteurs (Art. 128 ЗСВ).

3

Scheduling

2 months

The case is scheduled within two months of the receipt of the request (Art. 128(3) ЗСВ).

4

Session of the general assembly

The Prosecutor General, the Minister of Justice and the President of the Supreme Bar Council take part in the session, as does the petitioner (Art. 129 ЗСВ).

5

Adoption and announcement

3–6 months

The interpretative decision is adopted and announced within three months, and in cases of particular legal complexity within 6 months (Art. 130(1) ЗСВ).

2 months

Time limit for scheduling the interpretative case from the receipt of the request (Art. 128(3) ЗСВ)

3–6 months

Time limit for adopting and announcing a ТР: 3 months, up to 6 in cases of particular legal complexity (Art. 130(1) ЗСВ)

ТР, interpretative ruling and a decision under Art. 290 ГПК

The three acts are mixed up in everyday work, but they have a different adopting body, a different function and a different binding force. The distinction is decisive when you rely on one in an appeal, a reply or reasons.

This is the bridge between a specific cassation case and the abstract interpretative proceedings.

A common mistake when citing

Practising lawyers often cite as an “interpretative decision” an act that is in fact a decision under Art. 290 ГПК or a ruling under Art. 274(3) ГПК. These acts are binding casual practice, but they have no binding force towards everyone. Check the type of act before you use it as an argument for a binding interpretation.

Effect over time and loss of force

Interpretative decisions act for the future and remain binding until they are set aside by a new interpretative decision or until the interpreted provision is changed by legislation. This is where a serious practical risk lies: relying on a decision whose force has lapsed undermines your argument.

Check that it is still current before you rely on it

Old interpretative acts, including rulings of the Plenum of the Supreme Court from before the 1991 Constitution, may have lost force after a later change in the regulation. Relying on a repealed or outdated interpretative decision is a serious procedural error. Always check whether the ТР is in force and whether the interpreted provision has been amended since it was adopted.

Examples from current practice

Two current interpretative decisions of the ОСГТК of the ВКС can serve to illustrate the institution. In ТР No. 2/2023 in interpretative case (тълк. д.) No. 2/2023, ОСГТК (announced on 4 July 2024) the general assembly resolved the question of when peremption (перемпция, the lapse of enforcement proceedings) occurs where there are several jointly and severally liable debtors in enforcement proceedings. The act shows the function of a ТР: to give a single answer where practice has split.

A second example is ТР No. 4/2019 in interpretative case No. 4/2019, ОСГТК (announced on 14 October 2022), which unified the question of to whom the debtor's statement acknowledging the claim must be addressed for the limitation period to be interrupted under Art. 116, letter 'а' of the Obligations and Contracts Act (ЗЗД). Both acts illustrate the correct way to cite: with the decision number, the interpretative case number, the chamber and the date of announcement.

How to find and cite an ТР in practice

The official primary source for interpretative decisions is the website of the ВКС, where the interpretative cases are arranged by chamber (ОСНК, ОСГК, ОСТК, ОСГТК, ОСНГТК, as well as those joint with the ВАС). The law also provides for annual publication in a special bulletin.

Judiciary System Act (ЗСВ)

Art. 131

The procedure for opening and hearing interpretative cases is laid down in internal rules of the plenum of the relevant court (Art. 131а ЗСВ, new, State Gazette issue 62 of 2016).

Official Bulgarian text

„Тълкувателните решения се публикуват ежегодно в бюлетин, който се издава от ВКС или ВАС, а тълкувателните постановления - в двата бюлетина.“

Checklist before relying on an interpretative decision

Check that the act is an interpretative decision (or ruling), and not a decision under Art. 290 ГПК*

Establish the exact number, the interpretative case, the chamber and the date of announcement*

Make sure the ТР is in force and has not been set aside by a later interpretative decision*

Check whether the interpreted provision has been amended since the ТР was adopted*

Cite in the standard form: ТР No. X/YYYY in interpretative case No. Y/YYYY, [chamber] of the ВКС*
